    AGREEMENT BETWEEN THE REPUBLIC OF BELARUS
    AND THE RUSSIAN FEDERATION ON ENSURING EQUAL RIGHTS OF CITIZENS
    OF THE REPUBLIC OF BELARUS AND THE RUSSIAN FEDERATION TO FREEDOM
    OF MOVEMENT, CHOICE OF PLACE OF STAY AND RESIDENCE
    ON THE TERRITORIES OF THE STATES - PARTICIPANTS OF UNION STATE

    Ratified by the law of the Republic of Belarus of June 29, 2006 "on ratification of the Agreement between the Republic of Belarus and the Russian Federation on ensuring equal rights of citizens of the Republic of Belarus and the Russian Federation to freedom of movement, choice of place of stay and residence in the territories of the member States of the Union state" (national register of legal acts of the Republic of Belarus, 2006, n 106, 2/1228).

    The Republic of Belarus and the Russian Federation, hereinafter referred to as the Parties,
    proceeding from mutual interest in further strengthening of integration relations between the parties,
    guided by the desire to ensure the equality of the rights of citizens of one Party in the territory of the other Party in the field of freedom of movement, choice of residence and residence,
    taking into account the provisions of the Treaty establishing the Union state of December 8, 1999 and The Treaty between the Republic of Belarus and the Russian Federation on equal rights of citizens of December 25, 1998,
    have agreed as follows:

    Article 1

    Citizens of one Party legally residing in the territory of the other party shall be guaranteed equal rights with citizens of the other party to freedom of movement, choice of place of stay and residence, except as provided for in this Agreement.

    Article 2

    1. Citizens of one Party irrespective of the place of stay (residence) have the right freely to enter, leave, stay, follow transit, move and choose the residence in the territory of other Party, except for places for which visit according to the legislation of the Parties special permission, according to the valid documents specified in appendices 1 and 2 to this Agreement without migration card is required.
    Citizens of one Party at investigation from the third States can once enter the territory of other Party and leave from its territory to the state of nationality according to the documents specified in appendices N 1 and 2 to this Agreement which validity period expired.

    2. After the signing of this Agreement, the parties shall exchange, as soon as possible, through diplomatic channels, samples of the documents listed in annexes 1 and 2 to this Agreement, as well as information on the competent authorities responsible for the implementation of this Agreement.

    Citizens of one party who have arrived on the territory of the other party within 90 days from the date of entry are exempted from registration with the competent authorities at the place of residence.

    Article 4

    1. The fact that a person belongs to the citizenship of one of the parties is the basis for obtaining a permanent residence permit (application for a residence permit) without taking into account the period of temporary stay and obtaining a temporary residence permit in the territory of the other Party.
    2. Applications of citizens of one Party to obtain a permanent residence permit (residence permit) in the territory of the other party shall be considered by the competent authorities of the other Party within three months from the date of submission of all necessary documents provided for by the legislation of the parties.

    Article 5

    The rights of citizens of one party to freedom of movement, choice of place of stay and residence in the territory of the other party may be limited in the manner prescribed by the legislation of the other Party, in the interests of national security, protection of public order, protection of morality, public health, rights and freedoms of citizens.

    1. Citizens of one Party may travel to third States from the territory of the other party and travel from third States to the territory of the other Party in the presence of valid and executed in accordance with the legislation of the state of nationality documents for travel abroad, unless otherwise provided by International treaties of the parties.
    2. Minors are citizens of one of the Parties may go to third countries from the territory of the other Party in the manner prescribed by the laws of the state of nationality.
    3. The parties shall immediately notify each other through diplomatic channels about changes in the legislation of the Parties, governing the order of departure of minor citizens.
    4. The competent authorities of the parties will take measures to prevent the departure of citizens of the Parties to third States, in respect of which there are restrictions on travel, established in accordance with the legislation of the state of nationality and (or) the state of residence (residence).

    Article 7

    Citizens of one party during the stay in the territory of the other party must comply with the legislation of the other party.

    Article 8

    This Agreement does not affect the rights and obligations of the parties arising from other international treaties of the parties, if they establish broader rights to the citizens of the parties.

    Article 9

    Disputes arising out of the interpretation and application of this Agreement shall be resolved through consultations and negotiations.

    Article 10

    By mutual consent of the Parties this Agreement may be amended and Addendum issued in a separate Protocol which forms an integral part thereof, and shall enter into force in accordance with article 11 of this Agreement.

    Article 11

    1. This Agreement shall be subject to ratification and shall enter into force on the date of exchange of instruments of ratification.
    2. This Agreement is concluded for an indefinite period. Either party may terminate this Agreement by giving the other Party notice by diplomatic channels. In such event, this Agreement shall cease to be effective ninety days after the date of receipt of such notice by the other party.

    Done at St. Petersburg on 24 January 2006 in two original copies, each in the Belarusian and Russian languages, both texts being equally authentic.
